We currently have an exciting new opportunity for an accomplished and energetic Commercial Manager M3R, Design & Construct, to join our M3R team.

This role is the central point of day-to-day administration of the Main Works D&C Contract (the contract for the Runway Works). Reporting to the Head of Commercial, the role will be focussed on making sure that the Contractor and APAM all proceed with proper attendance to the rights and obligations they have agreed. The role is intended to make sure that the requirements of the D&C Contract are fulfilled. That all submissions, approvals, decisions, instructions and processes are being run in accordance with the Contract. The role isn’t to necessarily make the determinations or decisions under the D&C Contract, but to make sure that those determinations and decision ARE being made in accordance with the Contract.

The role will be the central point for all contract submissions and correspondence to and from the Contractor. Where directed or authorised, the Commercial Manager will act as the Principal’s representative. The role will draft correspondence to the Contractor, for review within the Commercial Team and approval by the Executive Director. In addition, the role will review and advise on all contractual claims or notices. It will ensure that all of the key obligations of APAM are in place and being properly implemented. The Commercial Manager will provide reporting and details into the Governance team.

Key responsibilities:

The role's duties and accountabilities include, but are not limited to:

  • Ensure ongoing compliance with the Contract Administration Manual
  • Assure all contractual processes and correspondence are being attended to within the correct time periods so as to ensure no claims against APAM arise
  • Verify the Monthly Progress Payment regime is being managed and all obligations are met, including those of the Security of Payments Act
  • Be a key point of review in any claims or variations arising from the Contractor
  • Liaise closely with other team members in delivery (D&C) to ensure that site operations are compliant with D&C contract requirements, and if not then advise the Head of Commercial and ensure appropriate actions are taken
  • Provide reporting and governance systems support as required

The successful candidate will have:

  • Experienced Commercial Manager or Contract Administrator with a good level of understanding of typical AS4000 series D&C contracts.
  • Past experience should include working on multi-billion dollar projects in the infrastructure sector.
  • A preference would be to have legal or commercial background or training, noting the role is not that of a lawyer/legal advisor.
  • The successful applicant will demonstrate a strong commercial aptitude in a complex environment and will be comfortable operating as a collaborative team member in a values-based team environment.
