City Legal provides a range of cost-effective legal services which add value to Council's core business. The City Legal team sit within the Governance and Legal Services Group of Council and is well known for its progressive, collegial, and service-focussed delivery of specialist advice work and documentation that makes a positive difference to the city of Brisbane and its people.
The Role
An exciting opportunity to be part of an experienced and established Litigation, Risk and Enforcement team within Council, with a strong focus on enforcement and prosecutions.
Reporting to the Senior Legal Counsel Litigation, Risk and Enforcement, you will be responsible for appearing on behalf of Brisbane City Council and delivering timely, practical legal advice to internal clients with an emphasis on compliance, regulation and Council’s enforcement functions. This includes advising on evidence and prospects, supporting enforcement action pathways (including infringements and enforcement notices), and preparing and conducting prosecutions, trials and hearings in Courts and Tribunals. You will enjoy a balance of advisory and advocacy activities as a core part of your day-to-day role.
To be competitive for the role you will have significant relevant knowledge and experience in prosecutions, including a working knowledge of the rules of evidence, strong advocacy skills and the ability to quickly acquire knowledge on the broad range of legislation that Council operates under and enforces. You will also have significant experience in the preparation and conduct of trials and hearings in Courts and Tribunals.
Your responsibility will include but not limited to:
• providing high quality legal services and practical advice to clients and management in support of Council’s compliance and enforcement functions
• conducting prosecutions and advocacy on behalf of Brisbane City Council in Courts and Tribunals (including call-overs, hearings and trials)
• managing and conducting a diverse case list of enforcement and prosecution matters
• providing specialist legal advice on the proper construction and application of legislation, subordinate legislation and Council’s Local Laws, including advice on available enforcement options, evidence and prospects
• providing professional guidance and mentoring to staff and contributing to continuous improvement of prosecution and enforcement processes and templates.
To be successful you will have:
• right to be admitted to practise as a Solicitor of the Supreme Court of Queensland and hold, or be entitled to hold, a current Practising Certificate from the Queensland Law Society
• demonstrated significant relevant knowledge and experience in prosecutions and enforcement (including regulatory/compliance matters) and/or Local Government law
• significant experience in the management and conduct of prosecutions/criminal matters in the Supreme, District or Magistrates Courts, including preparation for hearing and trial
• demonstrated ability to provide specialist legal advice of Council’s Local Laws
• demonstrate expert negotiation and liaison skills, to achieve organisational objectives
• highly developed communication, organisational and prioritisation skills.
